MASK Awards Terms & Conditions

By participating in MASK Awards, the Participant acknowledges and agrees to the following:

 

1.     Entry

  • For the purpose of MASK Awards, the Participant understands what is the Intellectual Property and the Copyright. Mainly, “the Copyright” means any distinctive, creative expression and/or intellectual material.
  • The Participant warrants that the submitted Entry is his/her original work created under the Participant’s authorship and does not infringe upon other’s personality rights and intellectual property rights.
  • The School/Group Participants understand that they must give credit to entities and/or individuals involved in the creation of the Entry and have their consent for appearing in the Entry.
  • The Participant expressly grants the Recipient the non-exclusive rights to distribute, communicate and display to the public, and store in any form the Entry for purposes such as advertising, promotion, exhibitions, reporting, education, and reproduction on any media and platforms as well as in any format within the scope of the MASK Create work.
  • In the event of commercial activity including clause 1.5, the Participant will be entitled to receive compensation proportionate to the contribution of his/her Entry to the commercial activity.

 

2.     Commitments to Intellectual Property Rights

  • The Recipient will make reasonable efforts to acknowledge the Participant’s copyright authorship of his/her Entry whenever possible.
  • The Recipient commits to using the Participant’s Entry with due care, to present the Entry for viewing and communicate it to the public with the best quality available to the Recipient.
  • The Recipient commits to use the Participant’s Entry in good faith, on a non-profit and educational basis, respecting the moral rights of the Participant over his/her creative work, in line with the public policy and generally accepted principles of Participant’s moral rights, within the scope of the MASK Create work.

 

3.     Removal of Content

  • The Participant understands and agrees that the Recipient reserves the right to edit, alter, or remove Entries that may infringe on third party rights, personality rights, copyright ownership and authorship, be considered illegal, offensive, or inappropriate by MASK Create or other users, content to be removed in compliance with the national law and requested by the governmental body, with the purpose to maintain the integrity of the platform, deter the spread of unlawful content, reduce the risk of complaints or threats of legal actions by third parties.

 

4.     Personal Information and Data Privacy

  • The Participant understands and agrees that his/her personal information such as name, surname, age and place of origin, profile photo, professional or educational occupation, photographs and videos, artist portfolio, artist statement, exhibitions, artistic biography information will be used by the Recipient only to the extent necessary for public display and presentation of the Participant and his/her Entry within the scope of the MASK Create work, recommendation to relevant organisations for the Participant’s potential employment, internship or work opportunities, or/and MASK Create fundraising activities.
  • Information such as contact details, address, current location, health condition and any other information identified as private by the current national privacy law and GDPR will not be passed to any third party without Participant’s express written permission.
  • The Participant agrees to be contacted by the Recipient by using the communication means provided by the Participant in compliance with GDPR.
  • The Recipient collects and stores information that directly and indirectly refers to the Participant, within the scope of the MASK Create work, such as:
    • Participant’s information: name, age, gender, profile photo, biography, email address, country of residence, place of origin, date of birth, professional or educational information,
    • Entry related information: photographs and videos, artist portfolio, artist statement, exhibition history, artistic biography information and articles.
    • In line with the Recipient’s Privacy Policy and under GDPR, the Participant has the right to request for rectification and completion of the information provided, and to delete data previously consented for presentation or display in connection with MASK Awards. The Recipient will take all reasonable steps to remove the Participant’s details from all the sources.

 

5.     Prizes and Awards

  • Winning a cash prize or a title is not guaranteed, and the number of rewards are limited.
  • If the Participant fails to collect their cash prize in person at the Award Ceremony, the cash prize will be forfeited.
  • A family member or a colleague may collect the cash prize at the Award Ceremony on behalf of the Participant, provided that proof of family relationship or partnership is supplied if requested. It is the responsibility of the Participant to inform the Recipient that a family member or a colleague will be collecting the prize and provide their full name and contact details in advance. 
  • The Participant may be required to provide proof of age, such as a passport or driver’s license, to claim the rewards.
  • In the case of a school winning a prize, only a group of teachers, led by the Headmaster, and accompanied by a group of pupils, can collect the cash prize at the Award Ceremony. A cash prize will not be released otherwise. Proof of employment at the school may be required.
  • The Recipient shall not be held responsible for how the cash prizes have been used once they have been handed over to the winners.

 

6.     Social Media Policy

  • The Participant understands that it is his/her duty to subscribe to MASK Create’s social media platforms to stay updated about MASK Awards.
  • The notification about winners and the Award Ceremony will be updated on the social media channels. 
  • Key updates, such as winning an award or the cancellation of rewards, will be sent to the Participant via the communication channels provided to the Recipient. It is the Recipient's responsibility to regularly check those channels for any updates.

 

7.     Limitation of Liability

  • The Recipient cannot control how the third parties might use the content once it was made public, therefore the Participant should be aware of this risk. Furthermore, the Participant releases the Recipient from any claims, damages, liabilities, and demands regarding any third party’s misuse of the Participant’s displayed information on the Recipient’s platforms.
  • The Recipient is not responsible for any defamation, misappropriation and action against public policy, copyright or trademark infringement resulting from distributed and communicated to the public Entry on other media by any third party.

 

8.     Dispute Resolution

  • Parties agree to attempt to resolve any disputes in good faith before resorting to legal action. Any disputes that remain unresolved after mediation may be finally settled by the court in London, England.

 

9.     Complaints and Inquiries

  • In the event of a complaint or inquiry related to these Terms and Conditions, the Participant is required to notify the Recipient within thirty (30) days on the email contact@maskcreate.org
  • The Recipient acknowledges the complaint within five (10) working days, and finds a solution within four (4) weeks of receiving the complaint. If due to the complexity of the complaint, it will not be possible to find a solution within the aforementioned timeframe, the Recipient will hold the response and indicate the reason and time when the Participant will be further contacted. The timeframe for the final response will be eight (8) weeks from the date of receiving the complaint.

Definitions used in this Terms & Conditions

 

Participant: Any natural person or group of natural persons, submitting an Entry to MASK Create, also referred to as “he/she” or “his/her”.

 

Recipient: MASK Create UK, charity No 1128734, www.maskcreate.org

 

Entry: Submission of an original work to the Recipient with the scope of participating and being nominated for the MASK Awards.

 

Intellectual Property: Intangible property resulting from creative, intellectual, or inventive activity, including copyrights, trademarks, industrial designs, and patents.

 

Copyright: The exclusive and assignable legal right of a human author to control the reproduction and distribution of his/her original and creative work which is enforceable in a territory.

 

Copyright Ownership: Refers to any natural or legal person that owns all the economic rights over copyrighted material in a territory.

 

Copyright Authorship: Any natural or legal person that is the original author of the creative work who owns all the economic and moral rights over the work.

 

Personality Rights: The right of an individual to privacy and to forbid public representation of his/her personality without consent, to prevent any public exposure resulting in a potential or actual defamation act with the use of his/her identity or likeness, to control the commercial use of his/her name, image, distinct style, likeness, and identity.

 

Third Party Rights: Personality rights, authorship or ownership of an intellectual property right by a natural or legal person enforceable in a territory.
